Scope#
This Privacy Policy describes how Subliminal Labs Inc. ("Subliminal," "we," "us," or "our") collects, uses, discloses, and protects personal information in connection with our public website at subliminal.inc and any other website that links to this Privacy Policy (the "Site").
This Privacy Policy applies only to the Site. It does not apply to Subliminal customer engagements, pilots, workflow observability deployments, product services, or other services we provide to customers. Those activities are governed by the applicable customer agreement, order form, data processing addendum, or similar agreement.
The Site is operated from the United States and is directed to U.S. business visitors.
Personal Information We Collect#
Information you provide to us. We collect personal information you choose to provide through the Site, including your name, email address, company name, job title, and the contents of messages or other communications you send to us.
Information collected automatically. When you visit the Site, we and our service providers may collect information such as your IP address, browser type, device and operating system information, pages viewed, referring pages, approximate location derived from IP address, and interactions with the Site.
Information from third-party and public sources. We may receive business contact, company, and professional information from publicly available sources and third-party providers, including sales prospecting and data enrichment providers. We use this information to understand business inquiries, identify potential business customers, and support business-to-business outreach. If you would prefer not to be contacted, email [email protected] with the subject line "Do Not Contact" and we will suppress your record.
We do not intend for you to submit sensitive personal information through the Site, and you should not include sensitive information (such as government identifiers, financial account numbers, health information, or precise geolocation) in contact form messages or other website communications.
Categories of Personal Information#
For purposes of the California Consumer Privacy Act ("CCPA") and similar U.S. state privacy laws, the categories of personal information we have collected from Site visitors in the preceding 12 months, and the sources, purposes, and categories of recipients, are:
Identifiers (name, email address, IP address, online identifiers). Sources: you, automatic collection, third-party data providers. Purposes: respond to inquiries, sales outreach, Site security, analytics. Disclosed to: hosting, email, analytics, and sales tooling vendors.
Commercial information (company name, job title, products or services of interest). Sources: you, third-party data providers. Purposes: evaluate business opportunities, sales outreach. Disclosed to: sales tooling and CRM vendors.
Internet or network activity (pages viewed, referring URLs, interactions with the Site, device and browser metadata). Sources: automatic collection. Purposes: analytics, security, Site improvement. Disclosed to: hosting, analytics, and security vendors.
Geolocation (approximate, derived from IP address — not precise). Sources: automatic collection. Purposes: analytics, security. Disclosed to: hosting and analytics vendors.
Professional or employment information (job title, employer, business contact details). Sources: you, third-party data providers. Purposes: business-to-business outreach. Disclosed to: sales tooling and CRM vendors.
Inferences (interest in our services drawn from the foregoing categories). Sources: derived. Purposes: prioritize outreach. Disclosed to: sales tooling and CRM vendors.
We do not knowingly collect sensitive personal information through the Site.
How We Use Personal Information#
We use personal information to operate, maintain, secure, and improve the Site; respond to inquiries; communicate with you; evaluate and pursue business opportunities; conduct business-to-business sales and outreach; analyze Site usage; detect, prevent, and address technical or security issues; comply with legal obligations; and protect our rights, users, and business.
If we offer newsletters or marketing communications, we may use contact information to send those communications where permitted by law. You may opt out of marketing emails by using the unsubscribe instructions in the email or by contacting [email protected].
We do not use personal information collected through the Site to make decisions that produce legal or similarly significant effects about you, and we do not engage in profiling in furtherance of such decisions.
How We Disclose Personal Information#
We disclose personal information to service providers and vendors that help us operate the Site and our business. The categories include: hosting and content delivery (e.g., Cloudflare); analytics (e.g., Google Analytics); email and communications; CRM and sales engagement tools; security and anti-abuse providers; and professional services such as legal, accounting, and IT.
We may also disclose personal information to professional advisors, such as lawyers and accountants; to authorities, regulators, courts, or other parties where required by law or to protect rights and safety; in connection with a financing, merger, acquisition, reorganization, sale of assets, or similar business transaction; or with your consent or at your direction.
We do not sell personal information for money, and we do not share personal information for cross-context behavioral advertising or targeted advertising as those terms are defined under applicable U.S. state privacy laws. We have not sold or shared personal information for these purposes in the preceding 12 months, and we have no actual knowledge of selling or sharing the personal information of consumers under 16.
Retention#
We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to respond to inquiries, maintain business records, evaluate and manage prospective business relationships, operate and secure the Site, comply with legal obligations, resolve disputes, and enforce agreements.
The criteria we use to determine retention periods include the type and sensitivity of the information, the context in which it was collected, the purposes for which we process it, applicable legal or contractual requirements, operational needs, and our backup and archival practices.
Google Analytics data is retained according to our Google Analytics configuration and Google's applicable retention settings.
When personal information is no longer needed, we delete it or take steps to de-identify or anonymize it, subject to applicable law and our backup and archival practices. We may retain suppression records where needed to honor opt-out or do-not-contact requests.
Security#
We use reasonable administrative, technical, and organizational safeguards designed to protect personal information, including encryption of Site traffic in transit (HTTPS/TLS), access controls on internal systems, and diligence on the vendors that process information on our behalf. However, no website, network, system, or method of transmission is completely secure, and we cannot guarantee absolute security.
If we become aware of a security incident affecting personal information you provided through the Site, we will notify affected individuals and regulators as required by applicable law.
Children#
The Site is intended for a business audience and is not directed to children. We do not knowingly collect personal information from anyone under 16 through the Site, and we do not knowingly sell or share the personal information of consumers under 16. If you believe a child has provided personal information to us through the Site, please contact [email protected] so we can take appropriate steps to delete it.
U.S. State Privacy Rights#
Depending on where you reside and the law applicable to our processing of your personal information, you may have rights to: confirm whether we process your personal information; access, correct, delete, or obtain a portable copy of your personal information; opt out of the sale or sharing of personal information, targeted advertising, and certain profiling; and limit the use of sensitive personal information.
To submit a request, email [email protected] with the subject line "Privacy Rights Request" and describe the right you are exercising and the state whose laws you are invoking. We will respond as required by applicable law. We may need to verify your identity before fulfilling a request, and we may decline requests we cannot verify or that are not permitted by law.
Authorized agents. You may use an authorized agent to submit a request on your behalf. We may require written authorization from you and verification of the agent's identity.
Appeals. If we decline a request and you reside in a state that provides an appeal right (such as Virginia, Colorado, Connecticut, Texas, or Oregon), you may appeal our decision by replying to our response with the subject line "Privacy Rights Appeal." We will respond within the period required by your state's law. If we deny the appeal, you may contact your state attorney general to submit a complaint.
We will not discriminate against you for exercising privacy rights available to you under applicable law.
Changes to This Privacy Policy#
We may update this Privacy Policy from time to time. The "Last updated" date above indicates when this Privacy Policy was last revised. If we make material changes, we will take reasonable steps to notify you, such as by posting a prominent notice on the Site or, where appropriate, by sending an email to addresses on file. Changes are effective on the "Last updated" date unless we state otherwise.
